In accordance with the changes in the legislation of Ukraine in the field of product safety, related to the harmonization with European regulations, the transition was made from mandatory product certification to confirmation of its compliance with technical regulations.
A technical regulation is a legal act that defines the characteristics of products or related processes and production methods, including the relevant procedural provisions, compliance with which is mandatory. It may also include or contain requirements for terminology, marking, packaging, marking or labeling to the extent that they apply to the product, process or method of production. A normative legal act that has the characteristics of a technical regulation is considered a technical regulation, regardless of the use of the words “technical regulations” in the title of such an act.
Confirmation of conformity of products to the requirements of technical regulations is carried out in the legally regulated area on the basis of the Law of Ukraine “On Technical Regulations and Conformity Assessment” and is issued in the form of a declaration of conformity or certificate of conformity issued by an independent third party.

The set of technical documentation required to assess the conformity of products with the requirements of technical regulations must contain *:
- general product description;
- technical design and production drawings, diagrams of elements, assemblies, basic electrical diagrams;
- description and explanations of drawings and diagrams of products;
- list of standards from the list of national standards, which in case of voluntary application are proof of compliance with the requirements of technical regulations (in case of partial application of standards in the technical documentation indicate those parts (provisions) of standards that have been applied);
- results of design calculations, tests;
- test reports.

Voluntary certification (conformity assessment) of products and services is carried out in a legally unregulated area on the basis of Art. 24 of the Law of Ukraine “On technical regulations and conformity assessment” in accordance with the procedure established by the agreement between the applicant (manufacturer, supplier) and the conformity assessment body (certification).
Voluntary conformity assessment is carried out on a voluntary basis in all forms, including testing, declaration of conformity, certification and inspection, and compliance with any stated requirements.
The applicant independently determines which indicators he wants to confirm the compliance of products / services with the requirements of the standards. The conformity assessment body (certification) and the testing laboratory carry out a competent conformity assessment of products. If the result is positive, a certificate of conformity is issued, which is registered in the Register of the Voluntary Certification Body of SE “Kharkivstandartmetrologiya”.

To apply for a voluntary certificate, you must provide the following information:
- Name of goods;
- TN code FEA / DKPP;
- product description;
- test sample (or test report);
- technical characteristics (schemes, drawings, specifications);
- passports or security letters (if provided);
- invoice, supply contract (for a batch of products);
- declarations and certificates of other countries.
If the product is not subject to assessment of compliance with technical regulations and / or mandatory certification, but the customs service, regulatory authority or tender committee requires you to confirm this fact, you can contact the SE “Kharkivstandartmetrologiya” for a conclusion (certificate).
Conclusion (certificate) that the product is not subject to assessment of compliance with technical regulations and / or mandatory certification may be obtained by an enterprise of any form of ownership or an individual for goods those are not subject to technical regulations and are not subject to obligation.

The process of drawing up an opinion (certificate)
- the customer submits a request to the conformity assessment body (certification) of SE “Kharkivstandartmetrologiya” and provides supporting documents confirming the absence of grounds for conformity assessment and / or certification;
- the body for conformity assessment (certification) of SE “Kharkivstandartmetrologiya” checks the information specified in the accompanying documents;
- in case of confirmation of the information specified in the accompanying documents, a conclusion (certificate) is issued that the product is not subject to assessment of compliance with the requirements of technical regulations and / or certification.
